BEERVID USER AGREEMENT

2.1 Platform Definition

Beervid is an AI-driven marketing media generation and publishing platform. It acts as a middleware solution that integrates, optimizes, and fuses various artificial intelligence technologies and social media tools to provide Users with comprehensive marketing solutions.

2.2 Reliance on Upstream Providers

You acknowledge that the core AI generation engines and social media publishing interfaces are provided by third-party service providers ("Upstream Providers") and social media platforms ("SMPs"). Sphevolabs acts solely as a middleware platform to facilitate access to these providers.

3.1 User Content

"User Content" includes your inputs (text, data, media) and the Output Content generated by the Services. You act as the creator of the Output Content for liability purposes.

3.2 No General Monitoring for Confidentiality

To protect your business confidentiality and privacy, Sphevolabs does not proactively monitor or review your User Content. You are solely responsible for ensuring your content complies with applicable laws and does not infringe third-party rights. However, Sphevolabs reserves the right to investigate specific incidents if notified of potential violations.

4.1 Publishing Service

When you use Beervid to publish content to SMPs (e.g., TikTok), this action is executed through the SMP's API. You acknowledge that:

• Publishing Failures: Content publication may fail due to API limitations, network issues, or the SMP's own content moderation policies (e.g., the content is rejected by TikTok's filter). Sphevolabs is not liable for such failures.
• Post-Publishing Liability: Even if content is successfully published, it may still be flagged or removed by the SMP for violating their community guidelines. You are solely responsible for resolving such disputes directly with the SMP.

5.1 Credit System

Services are accessed by purchasing and consuming "Credits" on the platform.

• Consumption: Credits are deducted when you successfully use AIGC features.
• Generation Failures: If an AIGC task fails due to Upstream Provider errors or content moderation blocks by the Upstream Provider, credits will not be deducted (or will be returned to your account).
• No Refunds: Once purchased, Credits are non-refundable and cannot be exchanged for cash, except as required by applicable law.

6.1 Prohibited Acts

You agree not to use Beervid to generate illegal, pornographic, infringing, or harmful content.

6.2 Right to Terminate

Sphevolabs reserves the right to strictly enforce its policies. If Sphevolabs determines, in its sole discretion, that you have violated this Agreement or any applicable law, Sphevolabs may suspend or permanently terminate your account immediately without prior notice or explanation. You agree that Sphevolabs shall have no liability to you for any such suspension or termination.

8.1 "AS IS" Service

THE SERVICES ARE PROVIDED "AS IS". Sphevolabs DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED.

8.2 AI Specific Disclaimer

Sphevolabs DOES NOT WARRANT THAT THE OUTPUT CONTENT WILL BE ACCURATE, RELIABLE, OR ERROR-FREE. OUTPUT CONTENT MAY INCLUDE "HALLUCINATIONS." USE IS AT YOUR SOLE RISK.
